SAPPHIRE EU Commercial Warranty & RMA Policy

1. Your Statutory Consumer Rights

This Commercial Warranty is provided by SAPPHIRE in addition to, and does not affect, your statutory consumer rights under applicable law.

Consumers within the European Union are entitled to a statutory legal guarantee of conformity for a minimum period of two (2) years from the date of delivery of the product. If the product does not conform to the sales contract during this period, consumers may be entitled to the remedies available under applicable law, including repair, replacement, price reduction or termination of the sales contract, where the legal conditions are met.

Nothing in this Commercial Warranty limits, excludes or replaces your statutory consumer rights.

Important: Where required by applicable law, SAPPHIRE will display the official EU harmonised notice relating to the statutory legal guarantee at the relevant point of sale and on applicable product webpages.

 

2. SAPPHIRE Commercial Warranty

SAPPHIRE provides a limited Commercial Warranty for eligible products in accordance with the terms set out in this policy.

This Commercial Warranty is personal to the original purchaser and is not transferable, except where otherwise required by applicable law.

To make a warranty claim, please contact the retailer or reseller from whom the product was originally purchased. Proof of purchase (such as the original invoice or other acceptable documentation showing the purchase date) will be required when submitting a warranty claim.

 

3. What Is Not Covered by This Commercial Warranty

This Commercial Warranty does not cover:

  • Damage caused by misuse, abuse, neglect, accidents, improper installation, improper storage, liquid ingress, fire, flooding, power surges or other external causes.
  • Damage directly resulting from improper disassembly, repair, modification, or the installation of incompatible or unsuitable components, spare parts, accessories or consumables.
  • Products with removed, altered or illegible serial numbers that prevent product identification.
  • Counterfeit products or products whose authenticity cannot reasonably be verified.
  • Claims where the original purchase date cannot reasonably be verified through a receipt or other acceptable proof of purchase.
  • Normal cosmetic wear and tear that does not affect the functionality of the product.

These exclusions apply only to SAPPHIRE's voluntary Commercial Warranty. They do not limit or affect any rights you may have under the statutory legal guarantee or other applicable consumer protection laws.

 

4. Repair, Maintenance and Replacement Parts

SAPPHIRE graphics cards and ASIC devices are designed with advanced cooling systems to ensure long-term reliability and performance.

Routine maintenance, including cleaning, replacement of thermal interface material, or installation of SAPPHIRE-recommended replacement parts (such as cooling fans), does not automatically invalidate this Commercial Warranty.

Likewise, product disassembly or repair carried out by an independent repair provider does not, by itself, invalidate this Commercial Warranty.

However, SAPPHIRE may refuse coverage under this Commercial Warranty only to the extent that the defect, damage or loss of functionality was directly caused by:

  • improper disassembly or reassembly
  • improper repair or modification
  • installation of parts or accessories other than SAPPHIRE-recommended parts, or of incompatible or unsuitable parts or accessories
  • any action that directly results in physical damage or product malfunction.

Where such damage has occurred, repair may be offered as a chargeable service.

Nothing in this section should be interpreted as an undertaking by SAPPHIRE to provide repair services or replacement parts except where expressly offered by SAPPHIRE or required under applicable law.

 

5. Spare Parts and Repair Information (Where Applicable)

SAPPHIRE is committed to supporting the longevity of its products and to enabling reasonable end-user maintenance and repair.

5.1 Basis on which this section is provided

There is no general statutory obligation requiring SAPPHIRE to provide repair services, spare parts or repair documentation for every product. As at the date of this policy, SAPPHIRE graphics cards, mainboards and barebone systems (including mini PCs) are not among the product categories subject to mandatory reparability or spare-parts requirements under applicable European Union product legislation, including the product categories listed under the EU Right to Repair Directive. Accordingly, except where such legislation applies to a particular product, any spare parts and repair information described in this section are made available by SAPPHIRE on a voluntary commercial basis and may vary by product model and region.

SAPPHIRE recognises that the scope of European Union reparability and spare-parts legislation may expand over time to include further product categories. Where applicable European Union product legislation comes to impose repair or spare-parts obligations for a given product, SAPPHIRE will comply with those requirements for the products concerned.

5.2 Repair information SAPPHIRE will make available

Where applicable to a specific product model — as part of SAPPHIRE's commercial service offerings, or where required by applicable European Union product legislation — SAPPHIRE will make available product-specific information regarding reparability, compatible replacement parts, estimated costs (where applicable), ordering procedures for available spare parts, and appropriate repair or maintenance instructions. Such repair and maintenance instructions are provided by SAPPHIRE on request rather than published in full, except where applicable regulation mandates public access or alternative distribution methods. To request the instructions and recommended spare parts for an eligible product, please contact the SAPPHIRE customer service team. Any applicable technical limitations, compatibility requirements or restrictions relating to those repairs or spare parts will be clearly identified.

5.3 Effect on this Commercial Warranty

Using SAPPHIRE-recommended spare parts in accordance with the instructions provided (including any handling, torque and electrostatic-discharge precautions) does not by itself invalidate this Commercial Warranty. The effect of repairs, maintenance and replacement parts on warranty coverage is governed by Section 4, and nothing in this section limits or affects your statutory consumer rights.

 

6. Software and Firmware Updates

For products containing digital elements, SAPPHIRE will provide software and firmware updates necessary to maintain product conformity for the period required by applicable law or, where specified, for the minimum period stated on the applicable product page.

These updates may include:

  • VBIOS updates;
  • security updates;
  • compatibility improvements;
  • stability enhancements; and
  • functionality updates.

SAPPHIRE will not intentionally reduce the advertised functionality or performance of the product through conformity-related software or firmware updates.

Where a software or firmware update is expected to have a material impact on product performance or functionality, SAPPHIRE will, where reasonably practicable, provide clear information regarding that impact before installation and, where technically feasible, provide the customer with a choice as to whether to install the update.

 

7. Warranty Extensions

Unless expressly stated by SAPPHIRE, SAPPHIRE does not provide warranty extensions.

Any warranty extension offered by a retailer, reseller or distributor is a separate agreement between the customer and the provider of that extension. Such warranty extensions are administered solely by the organisation offering them and are not the responsibility of SAPPHIRE unless expressly stated otherwise.

 

8. Warranty Repairs and Replacements

Where SAPPHIRE repairs or replaces a product under this Commercial Warranty, replacement products or replacement components may be new, refurbished or reconditioned, provided they offer equivalent performance, reliability and functionality.

Any repaired or replacement product will remain covered for the remainder of the original Commercial Warranty period or for any additional period required under applicable law.

 

9. Changes to this Policy

SAPPHIRE may update this Commercial Warranty & RMA Policy from time to time.

Any changes will apply only to future purchases and will not affect Commercial Warranties already in force, except where required by applicable law.

 

10. Regional Information

This Commercial Warranty & RMA Policy applies to products sold within the European Union.

Commercial warranty terms for products sold outside the European Union may differ in accordance with local laws and regional business practices.

Products specifically marketed or sold for industrial, blockchain or cryptocurrency mining applications may be subject to separate warranty conditions. Customers should consult their retailer or reseller for details.

Certain SAPPHIRE products may become subject to additional repair obligations under future European Union product-specific legislation. Where applicable, SAPPHIRE will comply with those legal requirements.
